Shipping costs and delivery methods
XLNT undertakes to deliver the goods without undue delay and in any case not later than thirty days from the conclusion of the contract. The delivery of the products will be made by courier and the delivery time will vary depending on the destination. The terms indicated at the moment of the purchase order are however indicative.
XLNT delivers to all the countries indicated on the website; delivery will take place without appointment. For Italy delivery is free starting from an order value of € 100.00 (one hundred/00 Euro); for an order of a lower amount will be charged € 10.00 (ten/00 Euro) as a contribution to shipping costs. For foreign countries, delivery is free of charge from an order value of € 200.00 (two hundred/00 Euro); for an order of a lower amount € 30.00 (thirty/00 Euro) will be charged as a contribution to shipping costs. For countries not included in the list on the site will be expressed appropriate quotation of shipping on request.
No responsibility, for any reason whatsoever, may be charged by the Client to XLNT in the event of delay in the execution of the order or in the delivery of the Products covered by the Purchase Contracts.
The Products ordered will be sent to the postal address specified by the Customer. Upon delivery of the Products by XLNT to the courier in charge, an email will be sent to the Customer confirming the shipment.
Deliveries will be made from Monday to Friday, during normal office hours, excluding national holidays in the manner indicated by the courier chosen by the Customer. The delivery is considered completed when the Product is made available to the Customer at the address specified in the order form.
In case of non-delivery due to the absence of the recipient at the specified address, the courier will send a warning email and will attempt a new delivery in the manner prescribed by them. If it is impossible to make the new delivery due to the absence of the recipient, Customer Service will try to contact the Customer to schedule a further delivery. In the event that Customer Service is unable to contact the Client for the next 10 days or in the event of further impossibility of delivery due to the absence of the recipient, the Products ordered will be returned to XLNT. After 30 (thirty) days from the date on which the products ordered have been returned to XLNT for impossibility of delivery, the contract will be considered terminated and the purchase order cancelled in accordance with art. 1456 c.c.. XLNT will proceed to the reimbursement of the sum paid by the Client net of the expenses of the return of the Products and of the expenses of the custody of the same at the branch of the courier appointed for the delivery.
The termination of the contract and the amount of the refund will be communicated by e-mail. The amount of the refund will be credited to the means of payment used by the customer for the purchase. In the event that, before the expiration of thirty days, the customer requests to receive again the products purchased, XLNT will proceed with the new delivery by charging, in addition to the costs of the same, the costs of returning the products to XLNT and the costs of storage.
Upon delivery of the Products by the courier appointed by XLNT, the Customer is required to carefully check:
- That the anti-abrasion label is intact and the packaging is not damaged or otherwise altered.
- That the number of pieces in delivery corresponds to what is indicated in the transport document.
Any damage to the anti-abrasion label, to the packaging and to the Products or the mismatch in the number of pieces/collections or in the indications must be immediately contested by the Client, who can contact XLNT through the Customer Service specifying the order for which such mishaps occurred.
Cases of force majeure, unavailability of means of transport, as well as unforeseeable or unavoidable events that cause a delay in delivery or make delivery difficult or impossible or cause a significant increase in the cost of delivery to be borne by XLNT, will give XLNT the right to split, postpone or cancel, in whole or in part, the planned delivery or to terminate the Purchase Contract. In such cases XLNT will provide timely and adequate notice of its determinations to the email address provided by the Client and the Client will have the right to a refund of any price already paid, excluding any further claims of any kind against XLNT.
Right of withdrawal and its effects
The Customer has the right to withdraw from the contract, without giving reasons, within 14 days (withdrawal period).
The withdrawal period expires (i) after 14 days from the day on which the Customer or a third party, other than the carrier and designated by the carrier, acquires physical possession of the goods, or (ii) in the case of a contract for multiple goods ordered in one order and delivered separately, from the day on which the Customer or a third party, other than the carrier and designated by the carrier, acquires physical possession of the last good.
In order to exercise the right of withdrawal, the Client must inform XLNT of his decision to withdraw from the contract by means of an explicit declaration sent by post, fax or e-mail or by means of the appropriate form on the site, indicating in each case the order number and the products which are to be returned.
In order to comply with the withdrawal period, it is sufficient that the Customer sends the communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period.
In the event of withdrawal, the Client will be reimbursed for all the payments he has made in favour of XLNT, including the costs of delivery (with the exception of additional costs deriving from the possible choice of a type of delivery different from the least expensive type of standard delivery offered), remaining at the expense of the Client only the costs of redelivery of the products. The refund, according to the third paragraph of art. 56, of the Consumer Code, will take place following the receipt by XLNT of the return and after verification of compliance with the requirements. The refund will be full, or reduced if it is found that there is a decrease in value of the products returned, in which case XLNT will make contextually to the refund a communication which will indicate the amount deducted as a reduction of the refund and the reasons. Whatever the method of payment used by the client (credit/debit card, cash on delivery), the reimbursement procedure will be activated by XLNT in the shortest time possible, and in any case within fourteen (14) days from the date on which it became aware of the exercise of the right of withdrawal, once it has been verified that the withdrawal has taken place in accordance with the above conditions.
The customer must return the goods or deliver them to XLNT S.r.l. via A Manzoni 4F, Rudiano. (25030 – BS), without undue delay and in any case within 14 days from the day on which he communicated his withdrawal from this contract. The deadline is met if the Customer returns the goods before the expiry of the 14-day period. The direct costs of returning the goods will be borne by the Customer. The Customer is only liable for the decrease in the value of the goods resulting from handling the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.
The customer may not in any case exercise the right of withdrawal in the case of sealed goods that are not suitable to be returned for reasons of hygiene or health protection and have been opened after delivery.
